2. Purpose and scope

These Terms of Sale govern the online sale of the Pro Licences of the software applications published by WM STUDIOS, which unlock the Pro features of the relevant app. Use of each application is further governed by its own End-User Licence Agreement (EULA).

They apply to the entire WM STUDIOS software catalogue, present and future: any new application published by WM STUDIOS is automatically subject to them. Any order implies unreserved acceptance of these Terms of Sale.

3. Applications covered and prices

Each Pro Licence is a one-time payment granting a perpetual licence (no subscription). Prices are stated in euros (€).

  • Home Theater Maestro (HTM), Pro Licence: €79
  • PulseMyPortfolio (PMP), Pro Licence: €59

This list evolves as WM STUDIOS publishes new applications. The applicable price is the one displayed at the time of the order.

VAT not applicable, Article 293 B of the French General Tax Code (VAT-exemption threshold). Prices are net of VAT. WM STUDIOS reserves the right to change its prices at any time, without retroactive effect on orders already confirmed.

4. Orders

Orders are placed online. The process includes at least: selecting the Pro Licence, a summary, express acceptance of these Terms of Sale, then payment. The sale is concluded upon payment confirmation; a summary is sent by email.

5. Payment

Payment is processed by Stripe, a secure payment provider. WM STUDIOS has no access to your full card details. The order is only validated after payment authorisation.

6. Licence delivery

The Pro Licence is digital content delivered electronically: a licence code is sent to the email address provided, immediately or as soon as possible after payment confirmation. You activate this code inside the app (usually Settings → About → Pro Licence). If you do not receive it, contact support.

7. Right of withdrawal and waiver

In accordance with Article L221-18 of the French Consumer Code, the consumer normally has a 14-day withdrawal period.

However, for digital content supplied on an intangible medium whose performance begins immediately after purchase, Article L221-28, 13° provides for the loss of the right of withdrawal where the consumer has (1) given their prior express consent for performance (delivery of the code) to begin before the end of the 14-day period, and (2) acknowledged that they thereby lose their right of withdrawal. Acceptance of these Terms of Sale, required via a mandatory checkbox at the time of payment, constitutes that prior express consent and that acknowledgement. Once the code has been delivered with this consent, the sale is final. Exceptional cases (for example a non-functional licence) fall under the legal guarantees (section 8) and after-sales service (section 9).

8. Legal guarantees

The consumer buyer benefits from the mandatory legal guarantees, which cannot be excluded: the legal guarantee of conformity for digital content and services (French Consumer Code, art. L217-3 et seq.) and the guarantee against hidden defects (French Civil Code, art. 1641 et seq.). If the Pro Licence delivered does not work as described, the buyer may obtain its conformity or, failing that, a refund, under the conditions provided by law.

9. After-sales service

Support is provided via the “Contact support” button of the relevant app (Settings → About). It covers, in particular, any Pro Licence delivery or activation issue.

10. Liability

The seller's liability applies within the conditions and limits set out in the EULA of the relevant app and by law. No provision deprives the consumer of the rights they hold under mandatory provisions.

11. Personal data

For the sale, only the necessary data (email, payment data processed by Stripe) is used, for the purpose of fulfilling the order and invoicing. The applications published by WM STUDIOS run offline and send no usage data. Activating a Pro Licence is the only exception: it transmits the licence key and a pseudonymised device fingerprint, obtained by hashing, used solely to tell your devices apart. The details are in the privacy policy for licences.

12. Complaints and mediation

Any complaint is handled directly by WM STUDIOS, which seeks an amicable solution with the customer (via support).

Consumer mediation. In accordance with the provisions of the French Consumer Code on « the process of mediation of consumer disputes », after having contacted us and failing a response that satisfies you, you may refer the matter free of charge to a consumer mediation procedure with:

CM2C, Centre de la Médiation de la Consommation de Conciliateurs de Justice
49 rue de Ponthieu, 75008 Paris, France
Telephone: +33 1 89 47 00 14
Online referral: www.cm2c.net/declarer-un-litige.php
Email: litiges@cm2c.net

Recourse to mediation requires that you have first sent a written complaint to our support and have not obtained a response that satisfies you.

13. Geographic availability and territorial exclusion

The Pro Licences covered by these Terms are intended exclusively for persons located outside the United States of America. They are neither offered, nor sold, nor licensed to persons located or resident in the United States of America, including its territories and possessions.

By placing an order, the buyer represents and warrants that they are neither located nor resident in the United States, that they are not accessing the service from that territory, and that they are not acting on behalf of a person located there.

WM STUDIOS implements reasonable measures to prevent sales into that territory (payment restrictions and, where applicable, withdrawal of the relevant markets on distribution platforms). WM STUDIOS reserves the right to refuse, block or cancel any order placed in breach of this article; where that occurs, the order is cancelled and refunded.

The free Standard tier of each application remains available worldwide. The scope of this restriction may vary by application and may be lifted for all or part of the catalogue; the version of these Terms in force on the day of the order prevails.

14. Governing law

These Terms of Sale are governed by French law. In the event of a dispute, an amicable solution will be sought before any action; failing that, the jurisdiction rules protecting the consumer apply.

This English version is provided for convenience; the French version prevails. Publisher: WM STUDIOS, 61 rue de Lyon, 75012 Paris, France.

15. Language

These Terms of Sale are drafted in French. Any translation into another language is provided for information only, for the reader's convenience. In the event of a discrepancy in interpretation between the French version and a translation, the French version prevails and constitutes the sole contractual text.

This clause does not deprive the consumer of the mandatory consumer protection provisions of their country of habitual residence, where those are more favourable (Regulation (EC) No 593/2008, art. 6).
